[ARCHIVED] Sale of food outside of the fencing perimeter of the Luling Watermelon Thump

SALE OF FOOD OUTSIDE OF THE FENCING PERIMETER OF THE LULING WATERMELON THUMP

 

The City of Luling Code Enforcement Department, along with the assistance of the Luling Police & Fire Department, will have a strong presence during the upcoming Watermelon Thump this year; Thursday June 26th, Friday June 27th, Saturday June 28th, and June 29th 2025.

 Residential Districts

The City of Luling Code Enforcement Department will be, and can enforce the City’s Current Zoning Ordinances in regards to any residential district, to include, (R-1) Single-Family Residential, (RLD) Single-Family and Duplex Dwelling, (RMD) Single-Family, Two-Family, and Multi-Family, and (RHD) Multi-Family Dwelling Districts.  Within the residential district there will be no sale of food for purchase unless inspected and approved that it meets the requirements of the Texas Cottage Food Law.  People claiming to have fundraisers and/or are a non-profit will have to prove their 501(c) status.  Those found to be in violation shall cease operation, those found to be in violation, and continue, could receive a fine not to exceed $2,000.00 per offence, and each day any violation continues shall constitute a separate offence.  The City of Luling Police Department will be available to write citations for those that fail to comply.  

 Commercial Districts

For any food vendors wishing to sell food outside of the fenced boundaries of the Luling Watermelon Thump in a commercial district, to include, (C-1) Neighborhood Shopping, (C-2) General Commercial, and (C-3) Highway Commercial districts, the standards for inspection for food sales are subject to the Texas Food Establishment Rules with revision date August 2021.  The Texas Cottage Food Law, and 501(c) status still apply, it is the responsibility of the food vendor to ensure that they meet those standards.  Any food vendors that have violations that are detrimental to the public health, cannot obtain a permit, or shall fail to meet and maintain the minimum safety requirements of the Texas Food Establishment rules shall not receive a permit to continue sales and must cease business.  Any food permit issued by the City of Luling shall be on display.  All adopted International Codes still apply to ensure that activities are not detrimental to public health, to include the 2018 International Fire Code, 2018 International Plumbing Code, and the 2017 National Electric Code; any vendor found with these specific violations will be shut down immediately, the City of Luling Fire Department along with the City Fire Marshall will be available to determine any fire code violations.  All vendors to include food vendors, shall not sale on any public property, city right of way, public side walk, alley, or street without the consent and approval of the City Manager.
